Article Publication Agreement—Volume 2008

  1. The (“Publication”) agrees to publish

(“Article”) by __ (“Author”) in Volume 2008 of the Legal Forum. The Publication agrees to register Volume 2008 with the United States Copyright Office and to pay all registration fees.

  1. The Publication does not obligate itself to pay the Author any fee or royalty. The Publication will provide the Author fifty individual reprints of the Article; additional reprints may be ordered but must be paid for by the Author.
     
  2. The Author hereby grants and assigns the entire copyright in the Article to the Law School (“The Law School”) for its exclusive use. The Law School shall be the sole proprietor of the copyright, consisting of any and all rights of whatever kind or nature now or hereafter protected by the copyright laws of the United States and of all foreign countries, in all languages and in all forms of communication, including, but not limited to, books, magazines, newspapers, pamphlets, and any current or future electronic medium or data storage system. The Law School, through itself or others, shall have the right to publish the Article in all languages and in all forms of communication.
     
  3. The Law School grants the Author the right to reprint the Article in any book of which the Author is the author or editor, subject to the Author’s giving credit in the book to the original publication of the Article in the Publication. Such credit shall include the original copyright notice as it appears in the Legal Forum.
     
  4. The Author warrants that the Author has the right to assign the copyright to the Publication and that no portion of the copyright has been assigned previously. It is understood that no copyright to the Article has been registered with the United States Copyright Office or any other copyright office, but that in the event that such registration has taken place, the Author will promptly take all steps necessary to transfer the copyright to The Law School.
     
  5. The Author warrants that the Article has not been published in whole or in part (except as may be set out in a rider annexed hereto and signed by the Publication) and that no agreement to publish is outstanding. The Author warrants that he or she has obtained all necessary permissions to republish any copyrighted material contained in the Article.
     
  6. The Author warrants that the Article is an original work, that it contains no matter that: is defamatory or unlawful, invades individual privacy, casts any individual in false light, or infringes on any property right or any statutory copyright.
     
  7. The Author agrees to indemnify University and its Board of Trustees, The Law School and its Visiting Committee, individually and collectively, and the officers, agents, and future members of Publication, individually and collectively, against any claim to the contrary, including all reasonable expenses, losses, fines, penalties, court costs, attorneys’ fees, and liabilities suffered or incurred in connection therewith.
